Handling Dismissal

A client needed help in dismissing an employee who had been with the organisation for a number of years and so had ‘unfair dismissal rights’. This meant that the employer had to follow a process in dismissing the employee. The employee had acted in a way which allowed the employer to dismiss for gross misconduct but we still had to follow a process.

We helped the client :
• To follow the proper process around suspending the employee and investigating the issue
• To hold a formal disciplinary hearing prior to making the decision to dismiss.

We did this by :
• Providing advice and documentation to allow the manager to follow the correct process
• Attending the disciplinary hearing to act as note-taker and so to advise the employer.
